Spousal Support and Alimony

Spousal Support, also known as alimony, is the payment for the support and maintenance of a former spouse or partner.  It can be provided either as a lump sum or ongoing payment for a specified period of time.  Whether or not you will provide or receive support during or after marital separation or divorce is part of the divorce negotiation on court determination.

Spousal support is not necessarily granted in every divorce or legal separation case. Following are some of the factors the court takes into account when considering spousal support:

  • Reasonable needs
  • Ability to support themselves
  • Duration of the marriage
  • Health and of the parties
